Abstract

This study examines the use of torture in the investigative process to obtain confessions or information from criminal suspects from the perspective of Islamic Criminal Law, highlighting its significance in light of the tendency within some modern investigative systems to employ physical or psychological pressure to expedite information gathering. The study analyzes the justifications, impacts, and limitations of such practices based on Shariah principles that emphasize justice, mercy and the preservation of human dignity, through a detailed examination of textual evidence, the views of Muslim jurists and a comparison of opinions among the various schools of Islamic law. It underscores that any form of torture as an investigative method is rejected in Islam because it contradicts the objectives of Shariah (al-Maqasid al-Shariah) and the principle of justice, affirms that confessions obtained through coercion are invalid and stresses that investigative methods must be grounded in compassion, ethical conduct, and respect for humanity. The study further proposes that Shariah-based investigative approaches should be prioritized through professional training, judicial oversight and strict legislation to ensure that the fundamental rights of the accused are protected throughout the investigation process

Kajian ini meneliti pendekatan penggunaan seksaan dalam proses siasatan bagi tujuan mendapatkan pengakuan atau maklumat daripada suspek jenayah menurut perspektif Undang-undang Jenayah Islam. Isu ini penting kerana terdapat kecenderungan dalam sesetengah sistem siasatan moden yang menggunakan tekanan fizikal atau mental untuk mempercepatkan proses mendapatkan maklumat. Kajian ini memberi tumpuan kepada analisis pendekatan tersebut dengan menilai justifikasi, kesan, serta batasannya berdasarkan prinsip-prinsip syariah yang menekankan keadilan, rahmah, dan pemeliharaan maruah manusia. Kajian ini dijalankan dengan meneliti dalil dan pandangan fuqaha secara terperinci, membandingkan pendapat antara mazhab, serta menilai pendekatan tersebut berdasarkan prinsip dan nilai Islam. Kajian ini penting bagi mengetengahkan bahawa sebarang bentuk seksaan sebagai pendekatan siasatan ditolak dalam Islam kerana bertentangan dengan maqasid al-shariah dan prinsip keadilan. Islam menegaskan bahawa pengakuan yang diperoleh melalui paksaan adalah tidak sah, dan kaedah penyiasatan perlu berteraskan ihsan serta etika kemanusiaan. Kajian ini mencadangkan agar pendekatan siasatan berasaskan prinsip syariah diutamakan melalui latihan profesional, pengawasan kehakiman, dan perundangan yang tegas bagi memastikan hak asasi tertuduh terpelihara semasa proses siasatan berlangsung.
