Abstract
This study discusses the implementation of diyat as a form of punishment in Syariah criminal law in Malaysia, with a focus on the Kelantan Syariah Criminal Code Enactment (II) 1993 (Amendment 2015). Although diyat has a strong foundation in Islamic law and is clearly stipulated in the Kelantan enactment, its implementation is still hindered by the jurisdictional limitations of the Syariah Court under the Syariah Court (Criminal Jurisdiction) Act 1965 (Act 355) and provisions of the Federal Constitution. The objectives of this study are to identify the concept and foundation of diyat implementation according to Syariah law, examine its interpretation within the Syariah criminal justice system in Malaysia, evaluate the challenges of the Kelantan enactment in consistently and clearly providing for diyat, and propose improvements to the implementation of diyat and the judicial procedures involved. This study is conducted to identify the concept and foundation of diyat according to Syariah law, assess the substantive and technical challenges within the enactment provisions, and propose improvements for more effective implementation. Using a qualitative methodology in the form of doctrinal analysis of primary sources such as the state enactments, federal acts, the Qur'an, hadith, the views of Islamic jurists (fuqaha), as well as secondary sources including journals, articles, theses, and interviews with Syariah experts, this study finds a significant lack of uniformity between the states in Malaysia in providing for diyat. This situation raises serious implications for the principle of justice when the rights of victims and heirs depend on the state where the case occurs, rather than on a consistent principle of Islamic law. Furthermore, the absence of standard guidelines regarding the rate, form of payment, and implementation mechanisms for diyat has complicated the Syariah judicial process. This study suggests the creation of a national legal harmonization model that takes into account the socio-economic realities of Malaysian society, including the use of modern instruments such as gold, silver, or current financial rates to replace camels mentioned in classical texts. The findings of this study are expected to make a significant contribution to policymakers, Syariah judicial institutions, and lawmakers in reconsidering the position of diyat as an Islamic justice mechanism that is restorative and humane, while also strengthening the integrity of the Syariah legal system in Malaysia.

Kajian ini membincangkan isu pelaksanaan diyat sebagai salah satu bentuk hukuman dalam undang-undang jenayah Syariah di Malaysia dengan memberi fokus kepada Enakmen Kanun Jenayah Syariah (II) Kelantan 1993 (Pindaan 2015). Walaupun diyat mempunyai asas yang kukuh dalam hukum Islam dan telah diperuntukkan secara jelas dalam enakmen Kelantan, pelaksanaannya masih terhalang oleh kekangan bidang kuasa Mahkamah Syariah di bawah Akta Mahkamah Syariah (Bidang Kuasa Jenayah) 1965 (Akta 355) serta peruntukan Perlembagaan Persekutuan. Objektif kajian ini adalah mengenalpasti konsep dan asas pelaksanaan diyat menurut hukum Syariah serta bentuk penerjemahannya dalam sistem perundangan jenayah Syariah di Malaysia, menilai sejauh mana cabaran enakmen negeri Kelantan memperuntukkan diyat secara konsisten dan jelas, dan mencadangkan penambahbaikan terhadap pelaksanaan diyat dan prosedur kehakiman terlibat. Kajian ini dijalankan untuk mengenal pasti konsep dan asas diyat menurut Syariah, menilai cabaran substantif serta teknikal dalam peruntukan enakmen negeri, dan seterusnya mencadangkan penambahbaikan agar diyat dapat dilaksanakan secara lebih berkesan. Melalui metodologi kualitatif berbentuk analisis doktrinal terhadap sumber primer seperti enakmen negeri, akta persekutuan, al-Quran, hadis dan pandangan fuqaha serta sumber sekunder termasuk jurnal, artikel, tesis dan temu bual bersama pakar Syariah, kajian ini mendapati bahawa wujud ketidakseragaman yang ketara antara negeri-negeri di Malaysia dalam memperuntukkan hukuman diyat. Keadaan ini menimbulkan implikasi serius terhadap prinsip keadilan apabila hak mangsa dan waris bergantung kepada negeri di mana kes berlaku, bukannya kepada prinsip undang-undang Islam yang konsisten. Selain itu, ketiadaan garis panduan standard mengenai kadar, bentuk pembayaran serta mekanisme pelaksanaan diyat telah menyulitkan proses kehakiman Syariah. Kajian ini mencadangkan agar diwujudkan suatu model penyelarasan undang-undang di peringkat nasional dengan mengambil kira realiti sosioekonomi masyarakat Malaysia, termasuk penggunaan instrumen moden seperti emas, perak atau kadar kewangan semasa bagi menggantikan unta yang disebut dalam nas klasik. Hasil kajian ini diharap dapat memberi sumbangan penting kepada pembuat dasar, institusi kehakiman Syariah dan penggubal undang-undang dalam menilai semula kedudukan diyat sebagai mekanisme keadilan Islam yang bersifat pemulihan dan berperikemanusiaan, di samping memperkukuhkan lagi integriti sistem perundangan Syariah di Malaysia.
