Abstract

The study addressed the guarantees of interrogating the accused in Emirati and comparative law. The methodology of the study revolves around the analytical approach that presents the different legal and legislative frameworks in Kuwait and other countries related to the study topic. The researcher also uses the comparative method to identify the differences between Emirati legislation and other legislations in this field. The results of the study indicate that the right to defense is the basis of criminal justice fairness and is considered a key guarantee for it. The constitutional legislator in the UAE considers individual rights and freedoms as the basis of all freedoms and must be protected. The UAE law prohibits violating the guarantee of the accused's right to a lawyer and punishes the nullity of the act or procedure if it is done without the presence of the lawyer during the investigation. Based on the study results, the researcher recommends the importance of the UAE criminal law focusing on the suspect's right to a lawyer. All guarantees related to the right to defense should be considered during the evidence-gathering stage. The police officers are also advised to inform the suspect of the charges against him, the evidence presented against him, and the type of investigation being conducted with him. It is also suggested to activate a committee of experienced lawyers to spread legal awareness in the community and educate people about the right to defense in constitutions, international conventions, and professional rules governing the relationship between the lawyer and the accused. Finally, it is recommended that the guarantee of the accused's right to a lawyer continue even during the execution of the punishment and should be included in the prison regulations for inmates in disciplinary trials. The prisoner should enjoy the same guarantees and rights provided to ordinary individuals.
